The MIQUELRIUS backpacks (the ” Backpacks ” or the ” Backpack “, as the case may be) that you purchase are covered by a three (3) year legal guarantee against non-conformity (the ” Legal Guarantee “) pursuant to the provisions of the General Law for the Defense of Consumers and Users (Royal Legislative Decree 1/2007) (the ” LGDCU “).

In accordance with the LGDCU, you have, among others, the right to obtain from MIQUELRIUS the free repair or replacement of the Backpack that shows a lack of conformity within three (3) years after its delivery, provided that the lack of conformity existed at the time of delivery of the Backpack. Unless proven otherwise, any lack of conformity that manifests itself within six (6) months after delivery of the Backpack is presumed to have already existed at the time of delivery, unless this presumption is incompatible with the nature of the Backpack or the nature of the lack of conformity. In particular, defects or damage caused by misuse (such as the transport of unusual items), negligence, accidents, abrasion, exposure to extreme temperatures, solvents, acids, water, normal wear and tear, or transport damage (on airlines, for example) are excluded from this Legal Guarantee.

MIQUELRIUS informs you that, while any company may perform repairs or provide services to the Backpack without warranty, MIQUELRIUS is not responsible for improper or incorrectly performed repairs by third parties. We ask that you immediately inform us of any non-conformity of the Backpack and that you use the warranty services authorized by MIQUELRIUS to repair or replace it.

If you believe the Backpack is non-conforming, please contact the merchant [or online e-commerce platform] where you purchased it. You may benefit from the Legal Guarantee, if applicable, provided you provide proof of purchase of the Backpack and the date of purchase. Therefore, you must present the receipt for the Backpack purchase to the merchant [or online e-commerce platform].

[When you contact the merchant [or online e-commerce platform] where you purchased the Backpack, you will be informed of the estimated cost for shipping, the assessment of the Backpack’s non-conformity, and the diagnosis of the problem. This cost will only be borne by you if no non-conformity has been detected.]

In the event of a lack of conformity with the Backpack, you will be informed of the nature of the defect and the estimated time for repair or replacement of the Backpack or, where applicable, of the impossibility of repair or replacement of the Backpack and of the appropriateness, where applicable, of a price reduction or refund of the purchase price of the Backpack.

If the diagnosis of the Backpack’s non-conformity determines that it is not covered by the Legal Guarantee, you will also be informed of the estimated cost of the Backpack’s repair. This cost will be borne entirely by you. Your consent to this cost will always be obtained prior to initiating any type of Backpack repair. The costs of delivering the repaired Backpack will be borne entirely by you.

When the diagnosis of the Backpack’s lack of conformity determines that it is covered by the Legal Guarantee, MIQUELRIUS will repair or replace the Backpack in accordance with the remedy chosen by you, unless the remedy option chosen is objectively impossible or disproportionate, taking into account the value that the Backpack would have had if there were no lack of conformity, the relevance of the lack of conformity, and whether the alternative remedy could be carried out without major inconvenience to you. When the remedy option chosen is objectively impossible or disproportionate, MIQUELRIUS may choose the least burdensome remedy.

When the diagnosis of the Backpack’s lack of conformity determines that it is covered by the Legal Guarantee and the repair or replacement of the Backpack is impossible, including cases in which the Backpack cannot be replaced by a comparable product or when the original quality of the Backpack cannot be recovered with the repair, or when the repair or replacement, as the case may be, has not been carried out within a reasonable time or without major inconvenience to you, you will have the right to obtain a reduction in the purchase price of the Backpack or to obtain a refund of the purchase price of the Backpack at the cost of returning the Backpack in question. In accordance with the LGDCU, the price reduction will be proportional to the difference between the value that the Backpack would have had at the time of delivery had it been in accordance with the contract and the value that the Backpack actually delivered had at the time of delivery.

When the lack of conformity is covered by the Legal Guarantee, MIQUELRIUS will assume all costs of repair or replacement of the Backpack, as applicable, including the costs of shipping and redelivery of the Backpack.

Under no circumstances will MIQUELRIUS be liable for direct or consequential damages resulting from the lack of conformity of the Backpack.
